Legionnaires’disease is a potentially fatal form of pneumonia caused by the inhalation of small droplets of contaminated water containing legionella. All man-made hot and cold water systems are likely to provide an environment where legionella can grow. If conditions are favourable, the bacteria may multiply thus increasing the risk of exposure.
Managing your duty
The law requires that those in control of premises e.g. landlords who provide residential accommodation or who are responsible for the water system(s) in their premises have a legal duty to assess the risk from exposure to legionella to their residents, guests, tenants and customers. They can carry out a risk assessment themselves if they are competent, or employ somebody who is.
All water systems require a risk assessment but not all systems require elaborate control measures. A simple risk assessment may show that there are no real risks from legionella, but if there are, implementing appropriate measures will prevent or control these risks. The law requires these simple, proportionate and practical actions to be taken:
- Identify and assess sources of risk
- Manage the risk
- Prevent or control the risk
Periodically check that the control measures are effective.
